When you provide Yes To, Inc. ("Yes To", "we" or "us") with information through yestocarrots.com and m.yestocarrots.com (the "Sites"), we respect your privacy. It is important for you to understand what information we collect about you during your visit and what we do with that information.

Please note that this Privacy Policy governs only information provided by the Sites. It does not govern any other information or communications that may reference Yes To, e.g., communications from retailers.

INFORMATION WE MAY COLLECT ABOUT YOU

While maintaining our commitment to your privacy, we do collect personally and non-personally identifiable information about you. A detailed description of the types of information collected is outlined below.

Personally identifiable information includes your name, shipping address, billing address, email address, birthdate and credit card information. We collect this information during the online checkout and email newsletter registration processes so that we can properly fulfill your orders and requests.

Non-personally identifiable information includes your browser type, domain name, IP address and how you maneuvered through the Sites and may include your use of third-party websites. We collect this information so that we can identify general shopping and navigation patterns so we might better understand how to improve your experience with us.

COLLECTION OF PERSONALLY IDENTIFIABLE INFORMATION

We do not collect personally identifiable information about you, except when you provide it to us. For example, if you decide to complete a user registration form or online survey, you may be asked to provide certain information such as your contact information (name, email address, mailing address and telephone number), age group, gender and product concerns and the brands and products you use. If you decide to place an order, we will also need to know your delivery and billing address, phone number, credit card number and expiration date. To protect your personal information, users registering at the Sites may also be required to enter a user name/email address and password.

We contract with a third party partner (currently, Datapak Services Corporation) to provide online order selection and fulfillment services for Yes To products ("Fulfillment Partner"). All orders for products through these websites will be fulfilled by and through our Fulfillment Partner. By making a purchase through our website, you permit our Fulfillment Partner to provide us with your personally identifiable information after you complete your order.

If you would prefer that we not collect any personally identifiable information from you, please do not provide us with any such information. You will be informed what information is required and what information is optional.

When you submit your personally identifiable information on the Sites, you are giving your consent to the collection, use and disclosure of your personal information as set forth in this Privacy Policy.

COLLECTION OF NON-PERSONALLY IDENTIFIABLE INFORMATION

As you navigate through these Sites, certain anonymous information can be passively collected (that is, gathered without your actively providing the information) using various technologies, such as cookies, Internet tags or web beacons and navigational data collection (log files, server logs, clickstream). Your Internet browser automatically transmits to these Sites some of this anonymous information, such as the URL of the website you just came from and the Internet Protocol (IP) address and the browser version your computer is currently using. "Session" cookies are temporary bits of information that are used to improve navigation, block visitors from providing information where inappropriate (the Sites "remembers" previous entries of age or country of origin that were outside the specified parameters and blocks subsequent changes) and collect aggregate statistical information on the Sites. They are erased once you exit your Web browser or otherwise turn off your computer.

"Persistent" cookies are more permanent bits of information that are placed on the hard drive of your computer and stay there unless you delete the cookie. Persistent cookies store information on your computer for a number of purposes, such as retrieving certain information you have previously provided (such as passwords), helping to determine what areas of the website visitors find most valuable and customizing the website based on your preferences on an ongoing basis. The Sites may use Internet Protocol (IP) addresses. The IP address can be used to diagnose problems with a server, report aggregate information, determine the fastest route for your computer to use in connecting to Sites and administer and improve the Sites.

"Internet tags" (also known as single-pixel GIFs, clear GIFs, invisible GIFs and 1-by-1 GIFs) are smaller than cookies and tell the website server information such as the IP address and browser type related to the visitor's computer. Tags may be placed both on online advertisements that bring people to the Sites and on different pages of the Sites. Such tags indicate how many times a page is opened and which information is consulted.

"Navigational data" (log files, server logs and clickstream data) are used for system management, to improve the content of the Sites, market research purposes and to communicate information to visitors.

OFFLINE V. ONLINE PRACTICES

We may merge information collected about you through offline means with information that is stored in our databases along with information gathered online. CHILDREN UNDER 13

We take special steps to safeguard the privacy of children. These Sites are not intended for children under the age of 13. We will not knowingly collect personally identifiable information via these Sites from visitors in this age group. USE AND DISCLOSURE OF INFORMATION

Except as otherwise stated, we may use information collected via these Sites to improve the content of our Sites, to customize the Sites to your preferences, to communicate information to you (if you have requested it), to fulfill your orders with our Fulfillment Partner, for our marketing and research purposes and for any other purpose specified. In addition, we may make full use of all information acquired through these Sites that is not in personally identifiable form.

We do not sell, trade, or rent your email or phone number to anyone. We use outside shipping companies to ship orders (FedEx, APX, USPS, or UPS) and a credit card processing company to bill users for goods and services. These companies may receive personally identifiable information to help us process your order. With the exception of our Fulfillment Partner, these companies will not retain share, store or use personally identifiable information for any secondary purposes. Your personal data will be stored on file with our Fulfillment Partner for as long as your account is active.   • to contractors we use to support our business (such as fulfillment services, technical support, data storage and retrieval, delivery services and financial institutions), in which case we will require such third parties to agree to treat it in accordance with this Privacy Policy and use it for the same purposes;
  • in connection with the sale, assignment, or other transfer of the business of these Sites to which the information relates, in which case we will require any such buyer to agree to treat it in accordance with this Privacy Policy and use it for the same purposes; or
